By participating in the FAMSA Text Club, you agree to receive recurring telemarketing and promotional messages from FAMSA INC./FAMSA FINANCIAL INC. which may include text messages sent via an automated telephone dialing system to the mobile number provided at opt-in. These messages may include information about products, services, financing options, and other promotional content. Your consent to receive these messages is not a condition of purchase or financing.
Message & Data Rates
Message and data rates may apply. Message frequency will vary depending on the user’s interaction with FAMSA Text Club promotions and alerts. By agreeing to these terms, you acknowledge that message and data charges may apply from your wireless provider, and that you will be responsible for such charges.
Opting Out
You may opt-out of receiving messages from the FAMSA Text Club at any time by replying STOP to any message we send. After opting out, you will receive a confirmation message, and no further messages will be sent unless you opt back in. Texting STOP is the exclusive method for opting out. Please note that opting out of FAMSA Text Club does not revoke consent for other communications regarding products, services, or accounts you may have with FAMSA.

Changes to Terms & Conditions

In the event of a conflict between these terms and the Changed Terms, the Changed Terms will govern. However, the arbitration provisions detailed below will remain applicable to any changes.
Network and Carrier Issues
FAMSA INC./FAMSA FINANCIAL INC. is not responsible for any text messaging delays or issues caused by network malfunctions, outages, or any other carrier-related problems. We also are not liable for any violations related to the Telephone Consumer Protection Act (TCPA) due to carrier network failures.
Arbitration Agreement
By agreeing to these Terms & Conditions, you agree that any dispute or claim arising from or related to the FAMSA Text Club, including the use of automated text messages, shall be resolved exclusively by binding individual arbitration. The Federal Arbitration Act governs this provision, and any claim must be conducted per the rules of the American Arbitration Association (AAA).
Class Action Waiver
YOU AGREE THAT ANY CLAIM MUST BE ARBITRATED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO BE PART OF A CLASS ACTION OR TO JOIN YOUR CLAIM WITH OTHERS. The arbitrator may not award relief beyond what is allowed by law. Any arbitration hearing will take place in Houston, Texas, and will be governed by the laws of Texas.
Opt-Out Option
You may opt out of the arbitration clause within 14 days of joining the FAMSA Text Club by sending a certified mail letter with return receipt requested to:

Limitations of Liability
FAMSA INC/FAMSA FINANCIAL INC and its affiliates, officers, directors, employees, and agents are not responsible for any damages or losses, including but not limited to viruses, malicious code, or unlawful conduct by third parties, arising from your participation in the FAMSA Text Club. In no event will FAMSA INC/FAMSA FINANCIAL INC be liable for any indirect, special, punitive, incidental, or consequential damages, including lost profits or business interruption.
In the event of any issues or dissatisfaction with the FAMSA Text Club, your sole remedy is to cease participation.
Waiver and Severability
Failure by either party to enforce any right or provision in these Terms & Conditions shall not constitute a waiver of such right. If any part of these terms is found to be unenforceable, the remaining provisions will remain in full effect.
